SECTION 1 - OVERVIEW

1 - Overview.

This website is operated by Vittorio Ruschetta, trading as VERGINALE.

Throughout the site, the terms “we”, “us” and “our” refer to VERGINALE. By using this website and/or purchasing something from us, you agree to be bound by the following Terms and Conditions (“Terms of Service”, “Terms”). These apply to all users of the site, including but not limited to browsers, vendors, customers, and content contributors.

Consumers within the meaning of these Terms are any natural persons entering into a legal transaction for purposes that are not primarily commercial or self-employed professional activities (cf. § 13 BGB). Entrepreneurs are any natural or legal persons or partnerships acting in a commercial or independent professional capacity (cf. § 14 BGB).

 2 – Conclusion of the contract.

(1) The subject of the contract is the sale of goods and the provision of services via this website.

(2) The presentation of products on this website constitutes a binding offer to conclude a purchase contract.

(3) The contract is concluded through the online checkout process:

  • Products selected by the user are placed in the shopping cart.
  • The user is guided through the checkout process, including entering personal information, delivery options, and payment method.
  • Before submitting the order, the user may review and edit all order details.
  • By clicking the "Buy now" button, the user submits a legally binding acceptance of the contract offer.

(4) The order confirmation and contract-related information will be sent by email. Please ensure your email address is correct and functional, and that your inbox is not blocking messages due to spam filters.

3 – Right of retention.

(1) You may exercise a right of retention only if your claim arises from the same contractual relationship.

(2) The goods remain our property until full payment is received (§ 449 BGB).

4 – Liability.

(1) We are fully liable for damages arising from injury to life, body, or health.

(2) In cases of intentional or gross negligence, fraudulent concealment of defects, or assumption of a warranty, liability shall be unlimited.

(3) For slight negligence breaching essential contractual duties, liability is limited to foreseeable damage typical for such contracts. Liability for slight negligence in non-essential duties is excluded.

(4) We are not liable for continuous availability or error-free operation of the website and services due to the nature of internet communications.

5 – Governing Law.

(1) These Terms are governed by German law. For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the state of the consumer’s habitual residence is not withdrawn (Art. 6 Rome I Regulation).

(2) The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

The full contract text is not stored by us. Before placing yourorder, you can print or save the contract data using your browser. After ordering, you will receive all legally required information by email.

5 - Prices and Payment Methods
All prices listed are final prices. In accordance with § 19 of the German Value Added Tax Act (UStG), we do not charge VAT and therefore do not show it separately (Kleinunternehmerregelung).

Shipping costs are indicated separately and must be paid by you unless otherwise agreed. Payment methods are listed during checkout and include, for example, credit card, PayPal. Payment is due immediately upon contract conclusion unless otherwise specified.
 

6 - Delivery Conditions.

Delivery times and restrictions are shown in the respective product listing or during checkout.
Risk transfers to the customer upon delivery, except when the customer has arranged shipping independently (§ 446 BGB).

Note: Delivery dates are non-binding estimates unless otherwise explicitly agreed in writing.

7 - Legal Warranty Rights.

Statutory warranty rights apply.
Consumers are asked to report visible damage or missing items promptly upon delivery, although this is not a condition for the enforcement of warranty claims.

8 - Right of Withdrawal (Revocation).

Consumers have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days starting from the day on which you, or a third party other than the carrier and designated by you, acquires physical possession of the goods. To exercise your right of withdrawal, you must inform us (by providing your name, address, email, and order details) of your decision to withdraw from this contract by an explicit statement (e.g., a letter sent by post or email). You do not have to use a specific withdrawal form. To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal.
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. The reimbursement will be made using the same means of payment you used for the original transaction unless you have expressly agreed otherwise. 

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier. You must return or hand over the goods to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract. The deadline is met if you send back the goods before the period of 14 days has expired. You bear the direct costs of returning the goods.

Responsibility for Diminished Value.
You are only responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. If the returned goods show signs of damage or use beyond what is necessary to inspect them as you would in a physical store, we reserve the right to deduct an amount corresponding to the reduced value of the goods from your refund.

Your personal data is handled according to our Privacy Policy and the General Data Protection Regulation (GDPR). We are not responsible for third-party websites or materials linked to our site. Please review third-party policies carefully before any transaction.
